Millions of people are turning to AI chatbots when they’re at their lowest — and right now, almost nothing is stopping those chatbots from getting it catastrophically wrong. The American Medical Association just told Congress that this is a crisis waiting to happen. They’re right, and we’ve been too slow to care.
The AMA sent a clear message to lawmakers this week: the mental health AI space needs real guardrails, and it needs them now. According to Fierce Healthcare, the organization is pushing for stronger federal oversight of AI-powered mental health tools, citing serious concerns about clinical accuracy, data privacy, and — most critically — what happens when a person in crisis gets the wrong response from a machine pretending to be a therapist.
This isn’t theoretical. People are already using these apps instead of calling a hotline, instead of booking an appointment, instead of telling a human being that they’re struggling. The question isn’t whether AI belongs anywhere near mental health. It’s whether we’ve built the kind of infrastructure that earns the right to be there.
The Current Situation Is a Mess
Mental health apps and AI chatbots have exploded in the last few years. Woebot, Wysa, Replika, and a dozen others sit on people’s phones promising therapeutic support. Some of them do genuinely useful things — mood tracking, cognitive behavioral therapy exercises, breathing prompts. Fine. But they’re also operating in a regulatory gray zone that nobody has bothered to properly define.
The FDA has some authority over software as a medical device. HIPAA covers certain data situations. But the specific case of an AI chatbot having a real-time conversation with someone who just said they want to hurt themselves? There’s no clear rulebook. There’s no mandatory escalation protocol enforced by law. There’s no requirement that these companies have a licensed clinician anywhere near the product pipeline.
That’s insane. We regulate what a pharmacist can say about your medication more strictly than we regulate what an AI can say to someone in a mental health emergency.
Why Doctors Are Sounding the Alarm
The AMA isn’t anti-technology. These are physicians who’ve watched telehealth save lives and who understand what expanded access to care looks like when it actually works. When they show up in front of Congress asking for guardrails, it’s not because they want to slow things down. It’s because they’ve seen what happens when technology outpaces clinical judgment.
Mental health is uniquely high-stakes. A bad recommendation for a sleep app wastes your time. A bad response from a mental health AI at 2am when someone is in crisis can cost a life. Those two things are not in the same category, and we can’t keep treating them like they are.
The AMA wants things like mandatory transparency about AI limitations, clear crisis escalation pathways, human oversight requirements, and data protections that actually have teeth. These aren’t radical demands. They’re the bare minimum that should have been baked into every product before it launched.

Real Crisis Protocols
If a user expresses suicidal ideation, the system must immediately connect them to a human. Not offer a breathing exercise. Not pivot the conversation. A human being, a crisis line, a concrete next step.
Clinical Accountability
There should be licensed mental health professionals who are legally responsible for how these products behave. Not advisory board members who lend their names to a website. Actual accountability.
We’re at a moment where AI is being applied to everything from the future of farming to military disinformation — the kind of AI-powered grey zone warfare that governments are scrambling to counter. In every one of those spaces, the conversation about oversight started too late. Mental health is the one area where we genuinely cannot afford to have that conversation after the fact. The AMA is right to push hard. Congress needs to listen, and the companies building these products need to stop acting like regulation is the enemy of progress. Sometimes the guardrails are the product.
